1.“中標函(Letter of Acceptance)”指雇主對投標文件簽署的正式接受函，包括其后所附的備忘錄(由合同各方達成并簽定的協(xié)議構(gòu)成)。在沒有此中標函的情況下，“中標函”一詞就指合同協(xié)議書，頒發(fā)或接收中標函的日期就指雙方簽訂合同協(xié)議書的日期。

"Letter of Acceptance"means the letter of formal acceptance, signed by the Employer, of the Letter ofTender, including any annexed memoranda comprising agreements between andsigned by both Parties. If there is no such letter of acceptance, theexpression "Letter of Acceptance" means the Contract Agreement andthe date of issuing or receiving the Letter of Acceptance means the date ofsigning the Contract Agreement.

2.“投標文件(Tender)”指投標函和合同中規(guī)定的承包商應(yīng)隨投標函提交的其它所有文件。

"Tender" means the Letterof Tender and all other documents which the Contractor submitted with theLetter of Tender, as included in the Contract.

3.“投標函附錄(Appendix to Tender)”指名稱為投標函附錄并已填寫完畢的文件，附于投標函之后并構(gòu)成投標函的一部分。

"Appendix to Tender" meansthe completed pages entitled appendix to tender which are appended to and formpart of the Letter of Tender.
